Considering the provisions of art. 37 of EU Regulation 2016/679 (GDPR), it was not deemed necessary to designate the figure of the Data Protection Officer (DPO).
It should be noted, in particular, that Marina Molo Vecchio S.r.l. pursuant to art. 37, first point, letter a) of the GDPR, is not a public authority or a public body, the core activities of the Company do not consist, pursuant to art. 37, letter b) of the European regulation, in processing which, by their nature, scope and/or purposes require regular and systematic monitoring of data subjects on a large scale and furthermore the core activities of the Company do not consist, pursuant to art. 37, letter c) of the GDPR, in the processing, on a large scale, of special categories of personal data referred to in 9 or data relating to criminal convictions and offences referred to in art. 10.
Whenever you have access to the operational offices of the Data Controller (Ponte Spinola – 16128 Genoa, Via al Mare De André – 16128 Genoa, Molo Vecchio (Cotone) – 16128 Genoa, Pontile Y– 16128 Genoa) your image (personal data) will be filmed by a video surveillance system with image recording.
For the protection of company assets, in order to prevent criminal acts such as robberies, thefts, access by malicious people, vandalism, or anything else that could cause damage to the business itself and/or to the boats of customers moored at the docks (Ponte Spinola, Via al Mare De André, Molo Vecchio (Cotone) and Pontile Y), they will be constantly monitored by a video surveillance system. The Data Controller will therefore process the image displayed and/or recorded of the people who access the premises indicated above through video surveillance systems.
The legal basis for the processing of personal data for the purpose listed above is the legitimate interest of the Data Controller
The data will be processed using electronic tools for the detection/recording of images.
Your personal data may be accessed, for the purpose specified in point 3, by authorized personnel appropriately trained by the Data Controller of the personal data (e.g. employees and collaborators), who have undertaken to maintain confidentiality, data processing managers linked to the Data Controller by a specific contract and therefore all those public and private entities to whom communication is necessary for the correct fulfillment of the purpose referred to in point 3 and who have assumed an adequate legal obligation of confidentiality such as, for example, security companies and IT assistance companies and/or video surveillance system companies, who operate on behalf of the Data Controller.
Finally, your data may be accessed by judicial or police authorities in the event of a suspected crime or investigation.
It is understood that the data processed will be exclusively those necessary to achieve the specific purpose.
The updated list with the identification details of all data processing managers may be requested by you at any time from the Data Controller (see subsequent point 10), who will immediately make it available.
The data will not be subject to disclosure.
The data will not be transferred to recipients who may be located in non-EU countries.
The collection of data (images) for the purposes in point 3) is mandatory and if you do not wish to be filmed by the video surveillance system, you must not access it or leave the area.
The Data Controller will process the data (images) for the time necessary to fulfill the purpose of point 3) above and in any case no later than 48 hours after registration.
By contacting the Data Controller (email: mmv@mmv.it) or by calling 010 270111, the interested party can have more information or, where possible, exercise, at any time, their rights, pursuant to articles 15 to 22 of EU Regulation no. 2016/679.
Interested parties may also lodge a complaint with the competent Supervisory Authority. The right to update or integrate, as well as the right to rectification pursuant to art. 16 GDPR, cannot be exercised in practice in consideration of the intrinsic nature of the data processed (images collected in real time regarding an objective fact). The right to data portability pursuant to art. 20 GDPR cannot be exercised as the processing is carried out in execution of a legitimate interest of the Data Controller. The interested party may request to view the images in which he/she believes he/she was captured. The response to an access request may not include any data referring to third parties, unless the breakdown of the processed data or the deprivation of some elements makes the personal data relating to the interested party incomprehensible. After the retention periods indicated above, it will be impossible to satisfy the access request.
Il Regolamento UE 2016/679 (RGPD), garantisce che:

Si evidenzia, in particolare, che Marina Molo Vecchio S.r.l. ai sensi dell’art. 37, primo punto, lett. a) del RGPD, non è un’autorità pubblica o un organismo pubblico, le attività principali della Società non consistono, ai sensi dell’art. 37, lett. b) del regolamento europeo, in trattamenti che, per loro natura, ambito di applicazione e/o finalità richiedono il monitoraggio regolare e sistematico degli interessati su larga scala ed inoltre le attività principali della Società non consistono, ai sensi dell’art. 37, lett. c) del RGPD, nel trattamento, su larga scala, di categorie particolari di dati personali di cui all’9 o di dati relativi a condanne penali e a reati di cui all’art. 10.
Accedendo alle sedi operative del Titolare (Ponte Spinola – 16128 Genova, Via al Mare De André – 16128 Genova, Molo Vecchio (Cotone) – 16128 Genova, Pontile Y– 16128 Genova) la sua immagine (dato personale) sarà ripresa da un sistema di videocontrollo con registrazione delle immagini.
Per la tutela del patrimonio aziendale, onde prevenire atti criminosi quali rapine, furti, accesso di malintenzionati, atti vandalici, o quant’altro possa arrecare danno all’attività stessa e/o alle imbarcazioni dei clienti ormeggiati presso le banchine (Ponte Spinola, Via al Mare De André, Molo Vecchio (Cotone) e Pontile Y), le stesse sono costantemente monitorate da un sistema di videosorveglianza. Il Titolare pertanto tratterà l’immagine visualizzata e/o registrata delle persone che accedono alle sedi sopra indicate tramite sistemi di videosorveglianza.
La base giuridica del trattamento dei dati personali per la finalità sopra elencata è il legittimo interesse del Titolare
Il trattamento dei dati avviene mediante uso di strumenti elettronici per la rilevazione/registrazione di immagini.
Ai suoi dati personali potranno accedere, per la finalità specificata al punto 3, il personale autorizzato e opportunamente istruito dal Titolare del trattamento dei dati personali (es. dipendenti e collaboratori), che si sono impegnati alla riservatezza, responsabili del trattamento dati legati al Titolare da specifico contratto e quindi a tutti quei soggetti pubblici e privati cui la comunicazione sia necessaria per il corretto adempimento della finalità di cui al punto 3 e che hanno assunto un adeguato obbligo legale di riservatezza come ad esempio, società di vigilanza e società di assistenza informatica e/o dell’impianto di videosorveglianza, che operano per conto del Titolare.
Infine, ai suoi dati potranno accedere le autorità giudiziarie o di polizia in caso di ipotesi di reato o di indagini.
Resta inteso che i dati trattati saranno esclusivamente quelli necessari per il raggiungimento della specifica finalità.
L’elenco aggiornato con gli estremi identificativi di tutti i responsabili del trattamento dati, potrà essere da Lei richiesto in qualunque momento al Titolare del trattamento (vedi successivo punto 9), che provvederà immediatamente a renderlo disponibile.
I dati non saranno soggetti a diffusione.
I dati non saranno trasferiti a destinatari che si potrebbero trovare in paesi extra UE.
La raccolta dei dati (immagini) per le finalità al punto 3) è obbligatorio e nel caso non volesse essere ripreso dal sistema di videosorveglianza non deve farvi accesso oppure lasciare l’area.
Il Titolare tratterà i dati (immagini) per il tempo necessario per adempiere alla finalità del punto 3) di cui sopra e comunque non oltre 48 ore dalla registrazione.

Gli interessati possono altresì proporre reclamo all’Autorità di controllo competente. Non è in concreto esercitabile il diritto di aggiornamento o integrazione, nonché il diritto di rettifica di cui all’art. 16 RGPD in considerazione della natura intrinseca dei dati trattati (immagini raccolte in tempo reale riguardanti un fatto obiettivo). Non è esercitabile il diritto alla portabilità dei dati di cui all’art. 20 GDPR in quanto il trattamento è effettuato in esecuzione di un legittimo interesse del Titolare. L’interessato potrà richiedere di visionare le immagini in cui ritiene di essere stato ripreso. La risposta ad una richiesta di accesso non potrà comprendere eventuali dati riferiti a terzi, a meno che la scomposizione dei dati trattati o la privazione di alcuni elementi renda incomprensibili i dati personali relativi all’interessato. Decorsi i termini di conservazione sopra indicati, sarà impossibile soddisfare la richiesta di accesso.
